AN ACT TO AMEND TITLE 10 OF THE DELAWARE CODE RELATING TO LIABILITY FOR SEXUAL ABUSE OF A CHILD BY AN ADULT EMPLOYEE OF A SCHOOL, ORGANIZATION, OR BUSINESS.

HB 277 provides additional protection to children who are sexually abused by authority figures in schools, organizations, and businesses. Currently, the school, organization, or business is not liable when employees take advantage of their place of authority to sexually abuse children. Private employers are already liable when their employees abuse children. This bill makes the standard of care consistent.

AMEND TITLE 14 OF THE DEL CODE RELATING TO FREE PUBLIC SCHOOLS.  

This bill needs your attention, as parents should be aware of any changes in public school structure for the sake of proactively protecting their children. The need for mental health counseling is increasing among young people, and HB 300 seeks to address this need by installing mental health centers in middle schools. BEWARE: Mental health counselors in public schools are not required to tell parents anything about meetings with their child. Mental health care is one important area that parents need to be proactively involved and fully informed about the services provided, to remain an active source of protection and guidance.

SB 99

AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO HIGH NEEDS EDUCATOR STUDENT LOANS. 

DE law currently allows for loan repayment for educators that teach in specific areas. SB99 repays loans of minority teachers simply for being a minority, regardless of where they actually teach. This bill is derived from and influenced by critical race theory. It assumes that minority teachers are not in a financial position for loan repayment, and fails to consider that white teachers that may have not come from affluent backgrounds are also struggling with student loan debt. The original repayment language simply sought to provide a service to all educators within high needs areas and did not place any sharp focus on one ethnicity. That was where they should have stopped. But they didn't.

QUESTION IS:  DO WE TRUST THIS?  IS THERE PARENTAL NOTIFICATION?  WHAT GUIDANCE or TYPE OF COUNSELING WILL TAKE PLACE?  COULD THIS BE DETRIMENTAL?  A 2017 survey of DE high school students found alarming statistics regarding students mental health (see bill for detailed stats).  This Act increases student awareness of mental health by requiring the Department of Education, with the approval of the State Board of Education, to establish and implement statewide mental health educational programs for each grade, kindergarten through grade 12, in each school district and charter school in this State; and requires Department of Education to annually report to the Governor and General Assembly regarding the implementation of this Act.
